Cancellations
If the wedding contract is cancelled by the clients, the non-refundable deposit payment will not be returned, it being the agreed loss suffered by the photographer/videographer due to cancellation. The clients hereby forfeit their initial deposit in case of cancellation and agree to pay the full amount for the services listed above should they cancel this wedding photography/videography contract within 30 days prior to the wedding date. In the unlikely event the photographer/videographer determines that they are unable to complete the contract, services may be canceled by AZ Painted Sky and the initial deposit will be refunded.
Postponements
If the wedding date is postponed, client is subject to a 10% rescheduling fee, it being the agreed loss suffered by the photographer/videographer due to postponement. If photographer/videographer is unavailable for rescheduled date, services may be canceled by AZ Painted Sky and the initial deposit will not be refunded.
Limit of Liability
In the unlikely event of total photographic failure or cancellation of this contract by either party or in any circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Any legal matters shall be held in the photographer/videographer’s home state, and any legal fees incurred by the photographer/videographer as a result of the clients’ prosecution will be paid by the clients.
Copyright, Reproduction and Model Release
The copyright of the photographs and videos is retained by the photographer/videographer at all times throughout the world. Where the digital version of the photographs and videos has been included for the clients as part of the wedding collection, these photographs and videos will include a print release and may be printed, and/or displayed online, for personal use. Commercial use must be expressly approved in written form by the photographer/videographer and include citation. This includes but is not limited to online bridal publications.
The photographer/videographer retains the right to use the photographs and videos for the purpose of advertising or otherwise promotion their work. Clients agree not to sell any of the files or prints without written permission from the photographer/videographer. The clients agree that they are signing a model release to allow the use of photographs and videos (of themselves and those pictured at their wedding) for the photographer/videographer’s business and promotional purposes.
Social Media
This clause applies to social media including, but not limited to, Facebook, Instagram, and blogs. When published online, it is required that citation of photographer/videographer be made. The clients agree that under no circumstances are they to alter the photographer/videographer ’s images or videos that are placed in public or on the internet as these images need to remain an accurate representation of photographer/videographer’s work, and so that future clients have a good understanding of photographer/videographer ’s brand and style. The clients agree to be responsible for any family member or friend who posts our photographs and videos online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way. The Wedding Film and Looks of Love Video played at the reception must not be posted on Social Media. However, AZ Painted Sky will provide a Wedding Highlight Video and a Looks of Love Video that can be posted on Social Media that will have different music that will be acceptable for those platforms.
Digital Product Delivery
All digital photographs and videos will be delivered to the clients no later than 60 days after the wedding ceremony.
Retention of Delivered Files
USB DELIVERY: Once the files are delivered to the clients, it is the clients’ sole responsibility to protect and retain their images and videos for the future. It is highly recommended that USBs be duplicated and stored in multiple locations in cool dry areas. Replacement USBs can be requested up to 1 year after original date received for an additional fee.
ONLINE GALLERY: An online gallery of images is available for download up to 1 month after delivery. It is highly recommended that the clients download and maintain an archive of all images for future reference. A replacement online gallery can be requested up to 1 year after original date received for an additional fee.
Satisfaction & Accuracy
The clients agree that the work delivered will be of a similar style and caliber to those photographs and videos in our website and/or blog, and that the photographer/videographer will have complete creative control during the photographs and video and in post-processing. The images will be delivered in JPEG format and deemed appropriate by the photographer/videographer. NO re-editing will be done after the final edited copies are presented to the client. All photographs and videos will be delivered to the clients no later than 60 days after the event.
The clients agree that the photographer/videographer can only capture the wedding that happens: weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs and videos. The photographer/videographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes.
Interference or Obstruction
No clients, wedding guests, attendants, and/or employees of the clients, may impede the photographer/videographer when he/she is shooting or performing duties, failure to comply may result in missed moments or fewer delivered images. Photographer/videographer also requests that clients request all phones, tablets, and cameras be put away during the ceremony to capture the best quality images possible. This “unplugged” atmosphere allows no hindrance in the ability to capture spur of the moment reactions and provides better quality photographs and videos. No other professional photographers will be hired by the clients or located on site photographing the clients during the event unless otherwise approved by AZ Painted Sky LLC. This responsibility will fall on clients to ensure all are in compliance.
